RENTAL AGREEMENT AND LIABILITY WAIVER
Effective Date: October 7, 2025
1. ITEM CONDITION AND USE
All rented items are commercially available consumer products made available in used but serviceable condition and may show signs of wear and tear. You agree to inspect the item upon receipt and before use. If you believe the item is unsafe, discontinue use immediately and report the issue via our website or email support@tryroundabout.com. Manufacturer user manuals and official safety instructions for most items are readily available online. If you are uncertain about how to use an item properly or safely, you agree to consult the manufacturer's documentation or reputable instructional resources before use. You agree to use items only for their intended purpose, following all instructions, user manuals, and safety guidelines provided by the manufacturer or RoundAbout.
2. RENTAL TERM
The rental term begins when the item is in your possession--whether through pickup or delivery--and ends when the item is returned to and received by RoundAbout or its authorized agent. Late returns may result in fees as outlined in our Late Fee Schedule, available online and linked at checkout.
3. FEES AND CHARGES
Rental fees and any applicable deposits are due at checkout. You agree to pay for any late return fees, damage fees, or replacement costs resulting from loss, theft, or misuse. RoundAbout reserves the right to assess reasonable fees for cleaning, repair, or replacement. RoundAbout processes payments securely through third-party payment vendors such as Stripe. By completing a transaction, you authorize RoundAbout and its payment processor to charge your designated payment method for all applicable fees. RoundAbout does not store your full payment information.
4. RETURNS AND PROCEDURES
In most cases, RoundAbout drivers or approved logistics partners will retrieve rented items from your designated return location. You agree to leave the item in a safe, accessible, and visible location by the return deadline. Failure to return the item as instructed may result in continued rental charges or replacement costs.
5. DAMAGE, LOSS, AND LIABILITY
You are responsible for any damage beyond normal wear and tear. If an item is lost, stolen, or damaged, you agree to pay up to the full replacement cost. You must notify RoundAbout immediately of any incidents involving rented items.
6. ASSUMPTION OF RISK AND RESPONSIBILITY
You understand that the use of rented items carries inherent risks, including the risk of property damage, personal injury, or death. You assume full responsibility for any use of any rented item during the agreed-upon rental period, including any period during which the item remains in your possession beyond the scheduled return time. This responsibility extends to any use by you, your household members, guests, or others to whom you make the item available. You agree to ensure that all users operate the item safely and appropriately, following manufacturer and RoundAbout guidelines.
7. LIABILITY WAIVER AND INDEMNIFICATION
To the fullest extent permitted by law, you hereby waive, release, and discharge RoundAbout, its officers, directors, employees, contractors, agents, investors, successors, and assigns from any and all claims, liabilities, losses, demands, or causes of action arising from or related to the rental, delivery, possession, or use of any rented item. This includes, but is not limited to, injury, damage, or loss caused by defects, malfunction, or improper use of any item, whether due to negligence or otherwise. You agree to indemnify and hold harmless RoundAbout from and against all claims, damages, costs, and attorney fees arising out of (a) your breach of this Agreement; (b) injury or damage caused by your use or misuse of the item; or (c) failure to follow safety instructions provided by RoundAbout or the manufacturer.
8. CANCELLATIONS AND REFUNDS
Reservations may be canceled up to 12 hours before the scheduled delivery or pickup time for a full refund. Cancellations made between 2 and 12 hours before delivery or pickup are eligible for a 50% refund. Cancellations made less than 2 hours before delivery or pickup are non-refundable. If you believe extenuating circumstances apply, or have questions about your refund eligibility, please contact RoundAbout Customer Support at support@tryroundabout.com.
9. TITLE AND OWNERSHIP
All rented items are owned by RoundAbout or made available through our consignment program, where ownership may reside with participating Members. Regardless of ownership, all items are managed, maintained, and distributed exclusively by RoundAbout, which may include the use of authorized third-party logistics partners for delivery and pickup services. Nothing in this Agreement conveys ownership or transfer rights to the renting Member.
10. GOVERNING LAW AND DISPUTE RESOLUTION
This Agreement shall be governed by the laws of the State of Georgia, without regard to its conflict of law principles. Any disputes arising under or relating to this Agreement shall be resolved through binding arbitration administered remotely by JAMS (or a similar service), unless the parties mutually agree otherwise. Arbitration shall occur in Forsyth County, Georgia.

12. ACCEPTANCE
By proceeding with your reservation or checking the acceptance box during checkout, you confirm that you have read, understood, and agree to this Rental Agreement and Liability Waiver in its entirety.
